Man accused of Tucson killing to get another trial

Posted: Updated:

TUCSON, Ariz. (AP) - A man accused of first-degree murder in a 2013 shooting in Tucson will get another trial next month.

Pima County Superior Court jurors were unable to reach a unanimous verdict in the trial of 34-year-old Donald Earl Woods.

He's accused of killing Brandon Luster in the parking lot of a Tucson apartment complex in October 2013.

Prosecutors say argument earlier on the night Luster was killed prompted the fatal shooting.

But Woods' lawyer says some of the witnesses who identified his client held grudges against Woods and used the shooting as an opportunity for revenge.

Woods was being tried for first-degree murder and possession of a deadly weapon by a prohibited possessor.

The Arizona Daily Star says Woods previously served 12 years in prison for armed robbery and sexual assaults.
