Probation violation charges dismissed against Charlie Bothuell's stepmother

(WJBK) - Charges were dismissed Friday against the stepmother of 12-year-old Charlie Bothuell, the boy who was found in the basement after being reported missing for 11 days.

Monique Dillard-Bothuell was arrested on a probation violation and released on a tether last month after police say they found a gun inside her home during their investigation into Charlie's disappearance.

She and Charlie's father, Charlie Bothuell IV, were both in court for her hearing. Fox 2's Erika Erickson reports Monique was all smiles after the judge's decision was given.

The judge dismissed the probation violation charge for a lack of evidence.

"She didn't know that this weapon was even in the house," says attorney Mark Magidson.

An investigation into physical and mental abuse of the 12-year-old Charlie continues as the state petitions to determine the parental rights of the father. The allegations of abuse include threats of murder, grueling workout routines and severe beatings with a pipe until the boy was bloody.

Meanwhile, the boy is in the custody of his biological mother.

No one has been charged in the disappearance of the boy. Authorities are continuing the investigation.
