DA Drops Murder Charges In 2012 Check Store Owner’s Killing

North Philadelphia, Pa.- Murder charges have been withdrawn for a man accused in a 2012 killing at a check cashing business.

His attorney says cell phone records proved the suspect was nowhere near the crime scene, and the DA agreed.

"Nobody knows the pain that I have. Only me. I mean they do, but they'll never feel what I feel, never," said the victim’s mother, Gertrude Blumer.

The mother is heartbroken again now that the Philadelphia District Attorney's office has withdrawn murder charges against the man accused of killing her son, 53-year-old Joel Blumer, two years ago.

"I cry every day, every night. I sleep with his picture," she said.

Joel Blumer was gunned down on his way into his North Philadelphia check cashing business at 26th and Sterner Streets in March of 2012.

"I just keep waiting for him to walk in the door. And it's just hard, really hard," his mother said.

Investigators arrested and charged, Eric Locke, after several witnesses identified him.

However, Locke's attorney says his client was nearly 200 miles away visiting the mother of his children at the time and had the cell phone records to prove it.

"Cell phones as you may know ping off of towers and it was very easy to identify and locate where those phone calls were coming from and they weren't coming from Philadelphia or anywhere near Philadelphia," said attorney Paul Vochi

Vochi says Philadelphia police sat on those records for two years, calling them key to his client's freedom.

He also says the witnesses in the case were flawed from the start.

"Our investigation revealed that of those four identification witnesses two initially did not identify my client at all, but did so after police went back to them with a person of interest being my client," said Vochi.

Now the painful search for answers starts anew for Joel Blumer's mother.

"I just hope I’m around to see justice for my son. That I do hope and I hope it will be soon," said Blumer.

Eric Locke has just been released from prison. He is now at home.
