Trial for Chris Brown delayed until Wednesday

WASHINGTON -

The assault trial of R&B singer Chris Brown is on hold after the entertainer’s bodyguard was found guilty in D.C. Superior Court of punching a man outside the W Hotel.

The bodyguard was expected to testify in his boss’s defense, but his conviction has created new legal trouble for the singer. The trial is now on hold until Wednesday.

Brown’s bodyguard was planning to take the stand until his conviction Monday effectively threw the strategy out the window.

Christopher Hollosy wants to protect his right to appeal and is now seeking immunity from the government. Without it, Hollosy's attorney says the bodyguard will not take the stand.

Brown needs Hollosy, who defense attorneys say will provide the testimony that will clear the entertainer.

If the bodyguard takes the stand, attorneys for Brown say Hollosy will tell the court the singer threw no punches that October morning outside the W Hotel.

"Hollosy says my client didn't hit,” said Brown’s attorney Mark Geragos. “Hollosy said, ‘I hit him.’ So if that isn't crucial, I don't know what is.”

In trial testimony last week, Parker Adams told the court Hollosy hit him in the face after Brown threw a punch. A limo driver backed Adams up telling the judge he saw Brown throw a punch and then saw Hollosy finish him off.

A third witness says she saw Brown throw a punch at Adams, but did not see one thrown by the bodyguard.

Adams was trying to take a selfie with his girlfriend, Brown and another girl when the singer took offense and words were exchanged.

The question is now this: in order for the singer to get a fair trial, does the government have to offer immunity to the bodyguard?

"There are a couple of cases that seem to suggest the government has a duty to fairly treat a defendant and to extend immunity in certain situations,” said Geragos. “It’s going to be our argument this is one of those situations.”

Prosecutors asked Judge Franklin Burgess to postpone the trial until Wednesday so they can look at their options.

For Chris Brown, he remains locked up in a Virginia jail at least through Wednesday.

The entertainer is in custody for probation violations stemming from his 2009 assault conviction of then girlfriend, Rihanna.

As it stands now, the trial is still scheduled for Wednesday, but without immunity for the bodyguard, it is unlikely to happen and could be postponed for months.
