Pima County won't follow Tucson on pet-store rule

TUCSON, Ariz. (AP) - Pima County isn't going to follow the city of Tucson in passing a rule that requires pet stores to sell only dogs from shelters or nonprofit rescue groups.

The Tucson City Council earlier this month directed its staff to draft the rule for pet stores within city limits.

But the county, unlike the city, is prohibited by state law from dictating similar constraints on store owners.

An opinion from the Pima County Attorney's Office determined nothing in the state constitution or state law could justify interfering in where pet stores should acquire their inventory from.

The opinion says the measure would be unenforceable if county official approve it.

Tucson has more leeway in which laws it can adopt.
