PHOENIX (KSAZ) -

A Phoenix woman is behind bars, accused of shooting and killing her boyfriend but police say it wasn't a case of murder because the woman was a victim of domestic violence.

24-year-old Ashley Eide was arrested for manslaughter Saturday, accused of killing her boyfriend after a domestic violence incident.  Family members identified the boyfriend as 26-year-old Fernando Ruelas Junior. They say he didn't deserve to get shot in the back.

"We all make mistakes were all human beings and mijo happened to make a mistake just as well as the person who hurt him made a mistake," said Guadalupe Soto, Ruelas's aunt.

Family members of 26-year-old Fernando Ruelas Junior say they can't believe he's gone. They say Ruelas wasn't perfect but he was turning his life around and didn't deserve to die this way.

Police say Ruelas and his girlfriend, 24-year-old Ashley Eide got into a physical fight, Eide ended up with a black eye and Ruelas ended up dead. Officers found the man face down in the staircase apparently shot in the back.

"They should charge her with murder... why you going to shoot someone in the back? I mean he was walking away from the whole situation," said Gabriel Saenz, Ruelas's brother.

People who live in the apartment complex were shocked. "When I came out the body was like that and from what I heard was they were fighting and she chased him out the door," said Elizabeth Pacheco, a neighbor.

Neighbors say they noticed the couple wasn't getting along recently. "From what everybody says yes they constantly argued and stuff," said Pacheco.

Ruelas's family says the couple had only been dating for about 6 months. They believe Ruelas was breaking up with Eide which sparked the fight.

"They only got her story, he's not here to tell it so we don't know what's going on really. I mean to be shot... in the back walking away, manslaughter come on," said Gabriel Saenz.

A check of court records showed that Eide was arrested in 2009 for aggravated robbery and animal cruelty charges. Eide plead guilty in both cases and was sentenced to probation.
