Release ordered for sex offender because of delay

Posted: Updated:

PHOENIX (AP) - An Arizona appellate court says a man accused of being sexually violent must go free because authorities violated his rights by failing to timely schedule a trial.

The state Court of Appeals' ruling Friday says the delay of more than a year means that Steven Lane Fuller went without treatment that might have resulted in his release.

Fuller was discharged from prison in January 2012 after serving sentences for Pima County convictions for public sexual indecency and indecent exposure.

He was immediately transferred to the state mental hospital. That was after a Pinal County order judge granted prosecutor's request for civil proceedings on whether Full should receive treatment for sexual violence.

The case then fell in the cracks until February 2013.

Friday's ruling says Fuller is entitled to relief.
