NY man charged with killing elusive rape suspect

SPARROWBUSH, N.Y. (AP) - An upstate New York man's attempt to help corral a fugitive rape suspect has led to him fighting a murder charge.

David Carlson is accused of firing his shotgun twice at Norris Acosta-Sanchez this fall along the wooded road where Carlson lived with his wife and three sons near the Pennsylvania border in Sparrowbush. Carlson claims he was walking Acosta-Sanchez down the road at gunpoint so a neighbor could call police.

But something happened. Now it could be up to a jury to decide whether Carlson acted as a vigilante or in self-defense.

The grand jury indictment against Carlson includes a top charge of second-degree murder, but it also includes options for a jury to consider lesser charges of manslaughter and criminally negligent homicide. A trial could come next year.
