Security guard charged after firing shots at fleeing thief

ATLANTA -

Police have charged a private security guard who shot at a fleeing suspect.

Witnesses said that the guard fired multiple shots at a man who had just stolen a bag of money at a gas station on Cascade Road Tuesday afternoon.

Authorities charged the guard with reckless conduct, saying he failed to use good judgment.

Gary Stiles, Assistant Fulton County Police Chief who is not involved with Tuesday's investigation, said there are circumstances in which shooting at a fleeing suspect is permissible. But Stiles said the standard on how to react is not absolute.

"If the officer feels he or she is in implement danger of being killed or receive serious bodily harm, yes, the officer can employ deadly force without actually identifying the weapon that they believe is coming out of the suspect's pants," Stiles said.

In Tuesday's theft, the suspect did not have a weapon, but the guard reportedly told authorities that he pretended to have one.
