Man allegedly smoked pot while baby boy sat in hot car

Phoenix Police say the 31-year-old father of a 3-month-old baby who was left in a car for over an hour was smoking marijuana at the time.

Police spokesman Sgt. Tommy Thompson says that late Thursday night, they developed information that led them to believe that Daniel Bryant Gray was smoking marijuana with a work colleague when he forgot his infant son, Jamison Dean Gray, was in his car.

When he realized the boy was locked in the vehicle, it was too late. He was unresponsive and couldn't be revived.

Gray was booked into jail Thursday night on charges of manslaughter and child abuse. He is being held on $100,000 bond.

The temperature in Phoenix midday Wednesday was 102 degrees.

Gray initially told police he lost track of time after he stopped at BT's Sports Pub in Phoenix, where he works as a kitchen manager.

At an initial court hearing Friday, Deputy Maricopa County Attorney George Kelemen Jr. said that Gray didn't intend for his son to die, but likened the death to an inattentive drunken driver causing the death of a passenger.
Kelemen noted that Gray has a criminal record that includes convictions for possession of marijuana and aggravated DUI.

Earlier Thursday, before this turn of events, Phoenix police sent their investigation to the Maricopa County Attorney's Office to determine if charges would be filed.

"There are circumstances where we look at the situation and have to determine that even the most attentive parent might have made a similar decision that again resulted in a horrific accident," said Maricopa County Attorney Bill Montgomery.

On her blog, Jamison's aunt wrote: "Our family is beyond devastated. There are no words to describe the pain and heartache we are experiencing. I can't even imagine what his mother is going through."

The investigation is ongoing.
