Judge allows suit against AG Horne to proceed

PHOENIX (AP) - A federal judge has dismissed several claims in a lawsuit filed against Attorney General Tom Horne and an aide by a criminal investigator in their office but is allowing others to proceed.

Wednesday's decision by U.S. District Judge David Campbell allows defamation and conspiracy claims made by Margaret Hinchey to go forward against Horne and Chief Deputy Attorney General Richard Bistrow. But it dismisses negligence, invasion of privacy, discipline without cause and several other claims.

Hinchey sued in February, alleging that Horne and Bistrow retaliated against her after she told the FBI that the state's top prosecutor may have participated in illegal campaign activities.

Horne has denied the allegations. Spokeswoman Stephanie Grisham says he and Bistrow are confident the remainder of the accusations will also eventually be dismissed.
