It is something you hate to even think about. Is the person serving you food at a restaurant fighting a cold, but can't afford to take the day off?

It is a concern in D.C. and one D.C. councilmember says it is time to make sure every employee in D.C. is included in a mandatory paid sick leave policy.

Councilmember Tommy Wells says after reading an audit of the Accrued Sick and Safe Leave Act of 2008, he believes that all D.C. employees should be welcomed into the plan.

Currently, there are some workers who are exempt from the law which allows employees to accrue sick time. Restaurant servers, bartenders and some health care workers are excluded from the law.

Before the law was passed, some businesses complained it could hurt their bottom line. Wells says the audit proves that businesses are not harmed by the law.

The Restaurant Association Metropolitan Washington issued this statement Tuesday afternoon:

"The bulk of a tipped worker's compensation does not come from the employer but directly from patrons to the restaurant. Taking away the employee's option to swap shifts with another employee by instead requiring employers to pay a set amount for a lost shift, translates into a significant loss to the employee, while imposing onerous record keeping responsibilities on their employers."
