Trial prosecutors in the George Zimmerman case have asked the judge to look into a photo that was posted online by the daughter of defense attorney Don West.

According to the DailyMailOnline, West and his daughters are pictured in a photo posted on Instagram enjoying ice cream cones.

The caption to the photo included, 'We beat stupidity celebration cones' and '#dadkilledit.'

The prosecution says the photos were posted after West's cross-examination of the prosecution’s witness Rachel Jeantel.

The West family says the picture and comments were not in response to a specific witness and that family pictures are taken almost everyday.

The DailyMailOnline posted a statement from Mr. West that said: 'As a parent, we're not always proud of things our children do, but we love them anyway, and then we move on.'
