The cab driver accused of shooting an Alexandria police officer will remain in jail until at least a grand jury hears the case.
In a preliminary hearing in Alexandria circuit court a judge found probable cause to hold Kashif Bashir.
Prosecutors called more than a dozen witnesses to the stand including a teacher who witnessed part of the assault.
Erin Gagnon told the court she saw Officer Peter Laboy on his motorcycle with his emergency lights on when she heard a shot, looked up from the schoolyard where she was supervising students and saw his head snap back. Gagnon says she then yelled for the children to run back inside Lyles Crouch Elementary School.
Other witnesses pieced the story together, telling the court, a bullet fragment found at the scene matches the gun taken from the suspect.
The officer who found Laboy testified he was in the street next to his motorcycle bleeding profusely. He was conscious but could not speak.
Prosecutors’ opened the hearing by telling the court Officer Laboy was looking for the driver of a yellow cab wanted for disorderly conduct around a shop on South Saint Asaph Street.
Detective Kevin Thomas told the court he spotted the cab near South Washington Street and pursued it at a high rate of speed into Fairfax County, onto fort hunt road before the car collided with a guardrail, spun out and hit an oncoming car.
A Fairfax County Officer was first on the scene and arrested Kashif Bashir at gunpoint.
Inside the cab police say they found five to six beer cans, some of them empty, along with an iPod and a Sig Sauer nine millimeter pistol.
A firearms examiner told the court the gun is a match with a large bullet fragment found at the scene.
Testimony also revealed the gun recovered from Bashir held fourteen rounds of ammunition.
There was one in the chamber and thirteen rounds in a magazine that can hold fifteen bullets.
Outside the courthouse, Bashir’s father declined to answer any questions about his son.
The first officer to testify told the court he first saw Bashir inside his cab on Saint Asaph Street where the suspect "looked right through him" as if he wasn't there. The officer said he was trying to pull the cab over.
In all of the testimony there was no mention of a motive and outside the courthouse prosecutors declined to say why.
Peter Laboy’s brother was in the courtroom but left before speaking with reporters.
The judge found probable cause and sent the case to the grand jury.
Officer Peter Laboy's wife says her husband is recovering well and working hard.
Laboy was shot in the head while on duty back in February. Mrs. Laboy updated her blog yesterday, writing her husband did very well in therapy and even got a new gaming system to play. She says if it interferes with his therapy, she's taking it out of the room.
