Police have arrested a Phoenix woman for hindering prosecution. They say she allegedly knew her boyfriend raped a family member and protected him.

According to court documents, the 13-year-old victim told 34-year-old Kimberly Anne Upshaw she was sexually assaulted by Upshaw's boyfriend while asleep.

Upshaw took the victim to the hospital and a rape kit tested positive. However, while talking with detectives, Upshaw and the victim claimed an "unknown suspect" was the assailant.

During follow-up questioning, Upshaw continued to say it was an unknown male, documents allege. But finally the victim admitted it was Upshaw's boyfriend who sexually assaulted her.

Upshaw admitted she knew her boyfriend had done this but did not believe the victim. She stated she wanted to wait for the DNA results to prove it happened, police say. She admitted she was "a bad mother."

Police say she also warned the suspect by texting him, "Get out." Upshaw allegedly wouldn't disclose his location to police.

Upshaw is facing charges of child abuse and hindering prosecution.
