DETROIT (WJBK) -- Michigan Attorney General Bill Schuette has been dealt a setback in his attempt to have seven members of the Detroit Board of Education removed from their positions.
Schuette argued in court last month that the board members are holding office illegally because they were voted in by district and not at-large. State law requires school board members in communities with fewer than 100,000 students to be elected at-large.
But in a ruling just released Wayne County Circuit Judge John Gillis dismissed Schuette's lawsuit challenging the elections which allows the members to remain on the board.
Detroit School Board attorney George Washington received the order on Thursday and said in a release, "We are glad that this lawsuit has been exposed as the bogus claim that it always was."
So far there has been no comment from Schuette's office but last month FOX 2 legal analyst Charlie Langton spoke with the Attorney General who said he was willing and ready to take his fight all the way to the Supreme Court if necessary.
