NYC parents file suit against governor

Posted: Updated:

NEW YORK (AP) - New York City parents have filed a lawsuit against state officials for withholding $250 million in education funding after a deal over teacher evaluations failed to be reached.

The suit names Gov. Andrew Cuomo and Education Commissioner John King Jr.

It was filed Tuesday in Manhattan on behalf of 2 dozen parents and students.

It claims withholding the money "is unconstitutional and a violation of our children's rights.'"

The city DOE lost the money for the 2012-2013 school year after the city and the United Federation of Teachers failed to reach agreement by the Jan. 17 deadline.

Cuomo's office told the Wall Street Journal school districts that didn't meet the deadline "lost their funding as the law clearly states."

The state DOE hadn't received the lawsuit and declined comment.
