NORTH PHILADELPHIA -

Philadelphia Police say a homicide suspect was shot by an officer after a struggle over the officer's holstered gun.

Police stopped the car around 3:30 Friday afternoon for a vehicle violation when police found out that the man driving the car was wanted in a homicide investigation.

They asked the suspect, Maceo Emerson Waring, to exit the car.   Waring tried to grab the officer's gun out of it's holster.  There was a struggle and the officer's partner shot the suspect twice.   They kept struggling and one final shot was fired by the partner.

Police were able to subdue Waring.  He was transported to Temple Hospital where he is listed in stable condition.

The officer involved in the struggle received minor injuries and was not hospitalized.

Waring is wanted in connection with a homicide that took place on September 11 on the 4600 block of Horrack Street.
