An Alabama man says he won't give up his fight to keep his wife buried in their front yard. Jim Davis has asked the Alabama Court of Civil Appeals to block an order demanding that he dig up his wife's remains at their Stevenson, Ala. home.
Patsy Ruth Davis passed away in 2009. Jim Davis had her buried in the front yard of their home.
"This is where we raised her family and she wanted to be buried here," said Jim Davis.
The small city has sued to move the body somewhere else.
A county judge ruled to disinter Jim Davis' wife.
"It's like being hungry…you get sick inside when you sit and think about it. And you draw up and it's a terrible feeling," said Davis.
The county judge's ruling is being challenged in the Alabama Court of Civil Appeals.
City officials said that the front yard grave raises concerns about property values and long-term care.
The city's attorney says that Davis buried his wife illegally since council members denied his application.
Davis has placed a sign near the road stating "Let Patsy Rest in Peace." He said he will not move the grave.
"I've went my whole life – I've never been arrested, never had a ticket, never been in no trouble, but that's subject to change if somebody thinks they're going to come in my yard and digging up my wife. It ain't happening. Not in this century," said Davis.
It's unclear when the appeals court will make a ruling.
