Sotomayor arrested on 6th DWI after jail release

South Jersey's problem DWI guy has struck again.  Anderson Sotomayor of Vineland was arrested for the 6^th time in less than three months on suspicion of driving under the influence. 

Police pulled him over at the intersection of 7^th Street and Chestnut and say they saw him tossing out beer right before the traffic stop. 

"I read about it this morning.  I was really shocked that this is an ongoing thing," said Jessica Reyes of Cumberland County. 

We at FOX29 are shocked too considering he was released from jail just days before Thursday night's arrest.  We started asking questions as well. 

We visited the office of his public defender, attorney Suhail Perez. However, her office said she is not allowed to speak with the media, sighting New Jersey state restrictions. 

We also reached out to the judge that granted his recent bail, but we were told he was unavailable for comment. 

In a twist, FOX 29 discovered that New Jersey state law may actually be working in Sotomayor's favor. 

Westmont, NJ Attorney Megan J. Davies says state law does not adequately consider the risk of public danger when setting bail in cases like Sotomayor's.   

"Something the federal system does that the state of New Jersey does not do is they take into account consideration whether or not they find the defendant to be a risk to society," Davies said.  "That may be made a difference in a case like this one."

She said the law only guides judges in determining the possible risk of flight when setting bail.  Several attorneys say state lawmakers should consider changes to the law.
