WASHINGTON, D.C. - A man who was released this week after 28 years behind bars for a crime he didn't commit has been formally exonerated.
Donald Eugene Gates was freed Tuesday after DNA evidence showed he was innocent of a 1981 rape and murder. But D.C. Superior Court Judge Fred B. Ugast held off on throwing out the conviction after prosecutors asked for one more round of DNA testing.
However, in a court filing Friday, prosecutors said they no longer needed the additional testing. They asked the judge to throw out the conviction immediately.
Ugast signed the order Friday evening.
