Hundreds of DWI Convictions in DC Based on Faulty Breathalyzers

WASHINGTON - The District is dealing with a big problem. More than 300 motorists were convicted of DWI since the fall of 2008 based on apparently faulty breath test machines.

D.C. Attorney General Peter Nickles has notified public defenders and the local trial lawyers association that the Intoxilyzer 5000 had been miscalibrated. Some of the convicted motorists served jail time.

Defense attorneys say city officials should expunge the records of the convicted drivers, apologize for the inconvenience and pay them compensation.

Nickles says in the 11 cases that have gone to trial, city lawyers will ask to reopen the files and let the court decide what happens. At least one motorist has already filed a lawsuit against the city.
